Short Sale Woes—

Just like the picture above—A Duck Stuck in the Muck—Here is the latest in the saga of the Short Sale Woes here in the Lake Oroville Area Real Estate Market I am going to share with you.—Ready?  Ok then here goes— I wrote an offer back in August of 2010.  After much Ado–it just fell apart within the last week and my Buyers Cannot Purchase the Home as it turned out because the seller cannot sell the property.— It’s a Long Drawn Out Story that I am Not going to share all the details because it is of a personal nature but I will just say that if you are considering a Short Sale Purchase just Beware and Remember–Chances are it will be a Long Haul–things Can and Will happen that can mucky up your purchase through No Ones Fault really— just because things happen for a reason.— There are still some purchases that can be had at todays values (Even if they are Short Sales) just Be Prepared and Hang On and Don’t Spend Money on Your Appraisal Until You Have  Approval from the Existing Lender/s that they Agree to the Short Sale but also Signed Acknowledgement from the Seller/s or Whomever is on the Existing Loan/s weather or not they are on Title but Remember they are still on the Existing Loan/s and need to acknowledge they received a copy of  the letter of Short Sale Approval that will be addressed to them in that letter.

It has been an interesting year all right.—I will say that I have had and currently am having the pleasure working with Realtor’s who are Courteous, Professional and Generally Happy in their lives which I guess is why they are so Polite and Nice.— I hope both they and I will have the same good fortune in 2011.—–So before the interest rates head towards 8% which I believe they are starting to now (can’t keep the rates down artificially low forever)  if you are considering purchasing a home with prices still down you might want to consider buying now.

Names of Vietnam veterans at Vietnam Veterans ...

I am 58 these days.  My number in the draft was called in 1970 when I turned 18.  They were pulling the draft back then to about number 395.  My number came up at 15.  I knew I was going to Vietnam.  When I rode on the bus ride  from Orange to Los Angeles with the rest of the guys I admit I was nervous. The thought of joining had crossed my mind but it was only a thought and all of a sudden the draft was staring me in the face. When I got to the eye doc part he looked at my eyes–looked in a big book and then took a stamp out of his drawer and stamped a Big 4F on my paperwork.  He said I had dystrophy of the cornea and I wasn’t fit for military service.  — So I never had the privilage of serving my country in military service.—   I am Proud and consider myself to be Very Lucky to have been born into this world as an American.— God Bless my Mom and Dad who were both WWII veterans–I Miss them Both.—For those of you who did serve, I am saying Thank You. — For those of you who have friends or loved ones who sacrificed their lives I am saying God Bless Them and May They Rest in Peace.

Good News I learned from the Oroville Association of Realtors Meeting–

We have a once a month meeting at the Local Hof Brau on 5th Avenue, who serve GREAT Ham n Egg Muffin sandwiches by the way. Our guest speaker today was the new City Administrator, Harold Duffy.  I believe the gentleman is a great addition to our city.  He puts explanations in simple, orderly and ez to understand language when asked direct questions (I think that’s who we want in this kind of a position). I am excited about his enthusiasum and vision  in making sure the city council gets the correct information on the issues and items before them so the council will have a clear vision of what they are voting on. So I say–Welcome to our city Mr. Harold Duffy.

ps–The Oroville Association of Realtors has an area to collect canned food for the Salvation Army–Please stop by the office located at 1835 Robinson Suite A and help those in need and their children by leaving a can of food for them–Thanx. —

Governor Vetoes C.A.R.-Sponsored

Anti-Deficiency Bill

 

On Thursday, Governor Schwarzenegger vetoed SB 1178 (Corbett), C.A.R.’s sponsored bill that would have expanded anti-deficiency protections. In his veto message, the Governor made clear his view that the bill interferes with an existing contract. While disappointed in the Governor’s misinterpretation of the bill, C.A.R. is grateful to the almost 13,000 California REALTORS(R) who urged him to sign the bill by responding to the Red Alert.

C.A.R. sponsored SB 1178 to better protect homeowners going through foreclosure. SB 1178 would have ensured that homeowners keep the same “anti-deficiency” protections they have in the original loan after the loan has been refinanced.

California’s anti-deficiency protection for “purchase money” mortgages says that if a homeowner defaults on a mortgage used to purchase his or her home, the homeowner’s liability on the mortgage is limited to the property itself. The law has worked well since the 1930s to protect borrowers, ensure the quality of loan underwriting and allow borrowers brought down by financial crisis to get back on their feet.

Unfortunately, the 1930s law hasn’t kept up with current times. Current law doesn’t apply to loans used to refinance the original purchase debt, even if the refinance was only to gain a lower interest rate. Recent years of low interest rates have induced tens of thousands of homeowners to refinance their mortgages. During those years, almost no one realized that refinancing their mortgage to obtain a lower rate, they were forfeiting their protections and were becoming personally liable on the new note.

SB 1178 would have corrected this injustice by extending anti-deficiency protections to those who have refinanced their loans.
